This has been a big complication for a few months, but back in October of 2008, I had a physical exam and my provider billed, what I assumed at the time, my primary insurance company (Horizon NJ Health). However, two years later, Horizon took back that money and my provider has been billing me for that physical back in 2008. I called Horizon and apparently they took back the money because I had another health insurance, and Horizon was no longer my primary. I had not known about my other health insurance company, Aetna student health care, since they never gave me any information or membership details, and I was automatically enrolled for it when I entered my university. When I contacted Aetna, they told me that they weren't the primary insurance company because they were just student health care. After several phone calls back and forth between Aetna and Horizon... I STILL haven't figured out who my primary insurance company is since they both claim to be the secondary insurance (and they seem to have endless reasons why the other is primary). I contacted my provider and asked them who they have listed as my primary, and they seem to be clueless about it too (when I spoke to the receptionist and asked, they kinda changed the topic). Is it possible to have two secondary insurance? If not, who should be my primary insurance? If Horizon is my primary, doesn't that mean they shouldn't have taken the money back for the physical exam?

Rear Ended - Can I demand insurance?

I was in an accident last month in my brand new Volvo (not even a month old!). I was rear-ended, while I was at a stop sign. Damage is to the rear bumper, pretty bad, looks horrible...especially for a new car! No one was hurt, just shaken! We did not immediately file a police report. We exchanged information, and the the person who hit me told me that they would pay for my repairs out of pocket, and that they didn't want to get the police or insurance involved. We conversed on the phone for a few days, and they seemed like everything was going great, and I was supposed to meet them at their friends auto body shop for the repairs...long story short...they never showed. Bad part now is, I never got their insurance information, just license plate, DL, addresses(basically everything BUT insurance). That same day, I went to the police station and filed a delayed police report. Later that week, I went and got 3 different estimates, and the damage averages out to about $900. I contacted a friend of mine, who is a police officer, and they stated that I can issue a summons to the person who hit me for careless driving, and I will have to go to court. This is basically to show them that I'm not messing around. All I want is my BRAND NEW car fixed!!! I'm NOT going through my insurance because my deductible is $1,000, and the damage is less...not only that...it wasn't my fault! My insurance company advised me to have person who hit me's insurance take care of everything, at no cost to me. Here's what I need to find out...Can I send the person a demand letter, basically stating that I want them to have their insurance take care of everything? I have tried to call them, and they send me to voice mail, so reasoning is not an option any more. I don't really know how to go about this?! I want to try this on my own, and not get an attorney involved. I just want to tell them that if they fix my car, I will drop summons and further proceedings (like small-claims court, which I WILL sue for additional $$ for dealing with all this). This december I got paid on the 18th and i have left no money in there for my direct debit to come out when they took it out on 29th decemeber. I didnt realise this happened until friday 29th january and got a phonecall form them telling me they are cancelling my car insurance. I was angry as I had no letters to confirm this and no phonecalls. My phone is broken and I had changed my address (which i have given them about 10 times) they said there was nothing i could do and cancelled my insurance. They have now told me that because i havent paid that its been sent to the debt collectors and is a criminal offence!!! My argument is they did not change my address even after I had told them time after time. Is there anything I can do, or if anyone has any advice what I do now. I have set up a new insurance now but its 8 more than my last one!!

I'm hopefully buying a car next month and my brother has agreed to look after it for me as he has private land with his property so I can leave it with him uninsured and then I will insure myself before I go to uni in September and then collect my car. My brother says he will take it for a spin now and again to keep it warmed up which is fine by me but I'm worried as their will be no insurance listed for that car. Although my brother has his own car and his own insurance policy which says he can drive anyone else's car, I would be the legal owner of the car and have no insurance so was wondering if it would be possible for him to be accused of driving without insurance? Hope that makes sense. Also if a car needs an MOT does it have to be the legal owner that takes the car for MOT test or could my brother do it on my behalf (my brother lives 100 miles from me and I wouldn't have the insurance to drive it there). I live in CA. I have Mercury insurance. I had 3 old cars on my policy which was too expensive so I sold 2 of them. I was paying $273 monthly automatically deducted from my bank on the 21st of every month. I sold the first car Jan. 29th. On Jan. 30th I took release of liability to AAA DMV and then to my insurance agent asking for the car to be removed from the policy. On February 10th I sold the second car. I took the release form to AAA DMV then straight to the agent asking for release. When I look at my policy deducting the 2 cars my insurance should be about $180 per month. They tell me it will be about $210 per month. Today rolls around, I check my bank account and they have deducted $273 from my checking. I call the 800 number for Mercury. They tell me it needed to be in by February 5th in order to make the billing deadline. Then they said they will NOT refund the money they removed from my account or prorate because under writing takes time. Is this legal??????
